Do you ever get the feeling of a bossy little kid surrounded by bigger, older kids who are ignoring what he's telling them...running around and shooting his mouth off at them, trying to get them to play by his rules, but never accomplishing anything because there are too many for him to stay focused? That's about how I see Jack Thompson when he sends out his industry threats.

The Beta version that was released last week shows us all just how violent the game is and how inappropriate it is for play by anyone under 17, as the “Mature” rating it will surely receive indicates.



Here’s the deal, Mr. Gates: Either Microsoft undertakes dramatic, real steps, through its marketing, wholesale, and retail operations to assure that Halo 3 is not sold, via the Internet and in stores, directly to anyone under 17, or I shall proceed to make sure that Microsoft is held to that standard by appropriate legal means. I have done that before successfully as to Best Buy, and I shall do so again as to Microsoft and all retailers of Halo 3.

He is being a dick with his tone, but I don't see anything wrong with making sure a M rated game is kept from kids.

As nice as that might sound, any law that restricts the sale of video games has been struck down as unconstitutional. Arguing to a judge without a law in your favor is just frivolous...

I'm convinced that at one time, Jack Thompson was a respectable lawyer who treated his profession with respect.

But then a crazy alien earwig crawled into his brain and ate the part that keeps someone from going crazy. Now everyone is too afraid to take away his license to practice law because if you take the prized possession of a crazy man, he's liable to eat your face.

At least that's my theory, it's the only thing that makes logical sense...

I think lawyers should be disbarred from filing their own lawsuits. It's like letting a cop write his own tickets, they get to choose precisely what benefits them.

IT seems to me his major bitch this time is just the sales of this game to minors. Seems to me if he is supposedly concerned about that he should be talking to the stores that sell the game. I don't have a problem with being carded for a M rated game. I know Wal-mart does, I am sure other stores do it. Far as the stupid parents who buy there 10 year old kids GTA games thats not Microsofts or anybody elses fault other then the parent.

It doesn't matter what laws are in place preventing games from being directly sold to an age group when there are parents that blindly buy whatever their kids ask for. ... They're going to get their hands on it regardless...

Fuck this guy. I was playing Mortal Kombat when I was f'ing ten. It's not going to do anyting, cause there parents and friends are just going to buy it for them, if not, they'll play it anyways. This guy is dumb, and what he does is useless. We got more things to worry about besides the sales of M rated games to minors. lol

I dunno, I think he might be right...I mean, if games have taught us anything it's that we can kill whoever we like, as they only need to hit the right shoulder button afterwards in order to respawn.

IMO if they pass that law and not one for other media such as movies and music it should be unconstitutional. Completely unfair to single out video games and not movies. There were far more kids watching Spider Man 3 that were well under 10 than I have ever seen play a kiosk game anywhere. Of course once they realize they have no ability to play it they give up fast.

The exact same thing will happen that has happened in every other state.

The ESA will sue on grounds that it is unconstitutional.

The courts will decide in their favor, and toss the law.

The taxpayers will end up footing the bill for millions in court costs because these jackasses insist on trying to pass these inane laws.

I don't think it's Microsoft's or any video game company's problem. They make the games, put the "M" on it exactly like the law tells them to. So how is it their problem that GameStop, ebGames or some online store is selling them to kids under 17 at point-of-sale? It's like cigarettes. Is the manufactuer liable because the local 7-eleven sells to people under 18? I don't think so.

It's unconstitutional period, regardless of whether they're singled out. The first amendment is extremely broad, and as it stands now restriction to almost any material like this from anyone is a violation of it.

I'm not really clear how this applies to pornography though, as I know that generally is an exception. Anyone up for trying to explain that one?

BTW, this is also unapplicable. This would also cause the Mature rating to be de facto for 18 and up only, since at 17, you're still a minor. There are also Teen games that have "dismemberment", "evisceration" and "physical torture" of human beings. There are probably E games that have some variation of those actually. It would be next to impossible for stores to figure out what they could and couldn't sell.

BTW, why is it apparently OK to see non-humans being dismembered, eviscerated, raped and tortured, but humans are off limits? I've always thought that was a bunch of crap. It works that way to some extent with MPAA ratings, where violence against any entity that isn't human is much more acceptable (whether that be non-human animals, aliens, whatever).

the ESRB is a self-regulating body, put in place during the Mortal Kombat controversies of the 90s.

A game doesn't NEED a rating AT ALL to be sold, it's more of a market force in that stores may not carry the game unless it's rated.

Much in the same way, movies don't need ratings and theaters don't have to make sure someone is over 17 to see an R-rated movie. It's all industry regulation.

In both cases, self regulation came about because of fear of the government stepping in. That was far more likely to occur with film though, as the late 20s and early 30s (when the Hayes code came around, 1933 is the exact year it was established if memory serves) were a MUCH worse period for self expression than the US of the 90s and today.
