Although all these type of auctions state they are selling purely a picture they are worded in such a way so as to trick someone into thinking it's an actual system

eBay's full of this crap and I hate having to shift through it all before I can actually find something genuine

I personally couldn't do something like that. Cause you knwo there will be some little kid expecting a Nintendo DS system for Christmas but instead he will not get one cause his mother just wasted $180 on a photo.

Also it was worded to make it unclear. IF they wanted to report you as a scammer Im sure after a long process they would win. Needless to say you can expect a negative feedback over this.

There was a lot of people pulling similar crap with the release of GTA SA. They would post in the title GTA SA then they would hav ea huge description of the game. Then in the last line it would say it is just codes for the game. People was paying 40 to 50 dollars for this.

I think I know why my second DS system didn't sell as good now. I had FREE SHIPPING!!!* in the title. Bidders probably thought it was one of these scams without even clicking it :/ . I got $210 out of the first one, $187 out of the second. I had very few views on the 2nd one.

There's a fine line between purposefully trying to cheat someone out of their money and unknowingly selling something that is mistaken as something else.

This is the former, and people with those kinds of auctions should be banned and then prosecuted.

I can see both arguments, but I'm also the kind of guy that can't stand complete IDIOTS! If I was to be bidding ANY money on something, I would make sure to actually READ things. I can't say that if I was in the position I would actually make the person pay or not, but I would be sure to inform them they need to not be a dumbass. There should be no confusion as to if this is the system or a picture of the system. It states it in the description that you are not bidding on the system itself but a picture of it.
