According to the Ohio Department of Education, the student's family has filed a lawsuit.

Shouldn't there also be criminal charges for assault and child abuse?

Here's an update on this older story:
The family of a student who said a science teacher burned the image of a cross on his arm settled a federal lawsuit with his former school district in their effort to move past the incident, a lawyer said Thursday.

"It's really to put at least this part of the case behind them and to move on with things," said attorney Doug Mansfield of Columbus. "I think they regretted bringing the lawsuit."

The Mount Vernon school board on Wednesday approved a $121,000 settlement with the family of the student identified in the lawsuit only as "James Doe." The agreement would require the district to pay $5,500 to the family and $115,500 to the family's lawyers.

A similar suit by the family is still pending against the eighth-grade teacher, John Freshwater.

I've often wondered why the victims of these abuses of authority are the ones that get ostracized by the communities, instead of the perpetrators...

Why in the hell does the lawyer get literally 30 times the amount of money the actual victim gets?

Typically that's how lawsuits work. Lawyers work for free on the agreement that they get a gigantic cut of whatever settlement. People don't mind because they don't have money enough for a lawyer who could win, and end up having nothing to lose.

Also, as to why this was a lawsuit and not criminal charges, the most likely reason is that there was nowhere near enough evidence to file criminal charges. Civil suits only require a preponderance of evidence as opposed to no reasonable doubt. Much laxer standards.
