MS sueing Gameshark, boot cd?

MS is sueing gameshark, if a gameshark is released for xbox, could it let you play backups and homebrew stuff?

A Gameshark wouldn't allow 'backups' to boot, past experience has told us this & theres no reason for it to change (& yes I know about the PSX GS/AR knockoffs that had mod chip functions so dont bother mentioning them). A GS for Xbox might allow imports but not warez.

i actually cant see how it can prevent backups unless the system itself does a reset the gameshark would run the backup signed code or not the same way it would run a import
