in my experience: super punch-out donkey kong country donkey kong country 2 smash TV lemmings (which you really should be playing on PC, anyway) earthbound all run at about 95% speed, with transparency off and sound on mono. don't know if the DC is capable of differentiating. and also, unless you come up with some amazing fix, the mere fact that the project is open source is going to make it extremely easy for somebody with even the most bare-bones coding knowledge to remove the offending lockout. so please, don't do it.

i don't think there's any way you could lock out backups; the neoCD, like the segaCD and DC (initially at least) had no boot protection - in the not-being-able-to-read-unofficially-produced-CDs sense of boot protection (unlike the playstation). honestly i don't think it'd be a good move anyway, and ...
